Trump Nominates Kavanaugh to Supreme Court

"He's referred to the judge's role as that of an umpire, so I expect that with this particular issue or any others, if they were to come before him and he were to be confirmed as a Supreme Court justice, that he would continue to keep an open mind and just call the issues as they are before him in that case".

Kavanaugh's nomination comes as Trump's lawyers are resisting pressure to be interviewed by Mueller, who's investigating Russian interference in the 2016 presidential election, whether anyone close to Trump colluded in the meddling and whether Trump sought to obstruct the probe.

In addition to working in the White House Counsel's office under Bush, Kavanaugh also worked for independent counsel Kenneth Starr's investigation into the death of Clinton aide Vince Foster and the Monica Lewinsky probe that led to President Bill Clinton's impeachment.

That insider status can help Kavanaugh win over the Washington elite and secure enough Senate votes to avoid an embarrassing loss for Trump.

Schumer is plucking one part of what Kavanaugh wrote in a 2009 Minnesota law review paper without recapping his comments in full.

"Judge Kavanaugh presents a great threat to the faithful application of our nation's bedrock public health and environmental laws should he become a Justice on the Supreme Court", Sierra Club Executive Director Michael Brune said in a statement Monday evening. If she took the bait, then Democrats would have it in their power to stop the judge's confirmation by their own efforts, and that might justify endangering a Democratic senator or two if it meant forcing Trump to appoint a different kind of SCOTUS justice.

Maryland's junior senator, Chris Van Hollen, says Democrats need to persuade a few Republican senators that a conservative majority, with no moderating swing vote, would be bad for the country for a generation or more. It's unclear what evidence there is for that, other than Trump's promise to appoint anti-abortion judges.

"Rehnquist's dissenting opinion [in Roe...] stated that under the Court's precedents, any such unenumerated right had to be rooted in the traditions and conscience of our people", Kavanaugh summarized.

Outgoing conservative Justice Anthony Kennedy has upheld abortion rights with liberal justices. Critics argue Kavanaugh should have joined the stronger opinion; defenders say he was merely operating within the framework that both sides of the suit agreed on. Democrats plan to pressure two moderate Senate Republicans, Lisa Murkowski of Alaska and Susan Collins of ME, to oppose the nomination. Manchin emphasized the importance of the Affordable Care Act in his decision. Kavanaugh sided with a religious group that objected to having to notify their insurer or the federal government if they wanted an exemption.

"If the American people come to believe this court would overturn women's reproductive freedom and the ACA, we would get a majority of votes", he added.

The vice president also briefly discussed foreign affairs ahead of this week's key North Atlantic Treaty Organisation summit in Brussels, where President Trump is expected to demand USA allies contribute more funding for their own national defense.

"I especially want to express our gratitude to Mitch McConnell for all that he did to make this achievement possible", Trump said. Trump also has suggested he could pardon himself. "He has very strong views about a sitting president not being interfered with, with criminal charges or civil lawsuits". Bill Clinton, for example, "could have focused on Osama bin Laden without being distracted by the Paula Jones sexual harassment case and its criminal investigation offshoots", Kavanaugh wrote.

"Justice Kennedy's retirement makes the issue of Senate control one of the vital issues of our time", he told an audience in Fargo, N.D., last month.
