He was charged with one felony for violence against his girlfriend and another for 'forcefully attempting to prevent the victim from reporting the crime.' The alleged attack has left the woman bruised and with a ruptured eardrum.

The 24-year-old Foster, a first-round pick in 2017, is not participating in offseason workouts with the 49ers.

"In light of that injunction, this office intends to ask the Santa Clara County Superior Court to dismiss the misdemeanor charge at the next court date scheduled for April 30, 2018", the office said in a statement Monday. The judge also issued a no-contact order between him and the victim. If convicted, Foster faces more than 11 years in prison, according to the DA's office. He remains free on $75,000 bail. Foster just finished a solid rookie season and was expected to be a key part of the 49ers defense going forward. According to local prosecutors, Foster's 28-year-old girlfriend had to flag down a passing auto after he threw her out of his Los Gatos house.

The team made the announcement regarding Foster's absence over the weekend. At this point San Francisco does not have a defined plan for how to give Foster structure while away from team activities, per Trotter, but that is something the 49ers hope to finalize when meeting with Foster. After an infamous domestic-violence incident involving former Baltimore Ravens running back Ray Rice, the National Football League granted Commissioner Roger Goodell authority to give players a baseline six-game suspension for domestic violence allegations, even without a conviction, with the discretion to decrease or lengthen the time based on the circumstances of a case.

However, 49ers CEO Jed York, general manager John Lynch and head coach Kyle Shanahan released a joint statement saying Foster would be held out of the team's offseason program for the time being. "As previously stated, his future with the team will be determined by the information revealed during the legal process".
