Stormy Daniels' lawyer says Michael Cohen will be indicted within 90 days

It comes as USA attorneys confirmed on Friday that Cohen had been under criminal investigation for months. Previous search warrants allowed NY federal prosecutors to search multiple email accounts, the filing said.

It would also be one of the most significant developments thus far in special counsel Robert S. Mueller III's investigation of whether the Trump campaign and the Kremlin worked together to help Trump win the presidency.

Outlets say a hearing to address Cohen's restraining order request is scheduled for Friday.

Cohen is asking for the right to review the documents before investigators do, so he can determine if any information was covered by attorney-client privilege.

The FBI collected a trove of Cohen's devices and documents in the Monday raid, which is primarily focused on Cohen's business and personal affairs that are unrelated to his work as an attorney.

"This is of most concern to him", said Hendon.

A private sidebar then took place, and members of the press asked US District Judge Kimba Wood to make a transcript of that conversation public. "And anyone who has ever hired a lawyer a close third".

"This has clearly been a delay tactic from the outset", said Assistant U.S. Attorney Thomas McKay.

"The issues here are straightforward", he said.

And it turns out there's no such thing as Donovan-client privilege.

Federal Bureau of Investigation agents are believed to have taken documents relating to a payoff to Stephanie Clifford, the pornographic actor known as Stormy Daniels, who alleged she had a sexual encounter with Trump.

In Friday night's filing, Blakely and Harder argue that "where there are overlapping issues in criminal and civil cases, a stay "is appropriate to preserve [an individual's] Fifth Amendment Rights" - quoting from a federal court ruling from NY.

Daniels, whose name is Stephanie Clifford, is engaged in a battle using Cohen to keep silent about a 2006 sexual encounter she states she had with Trump.

The Southern District of NY prosecutors also heard from Trump Organization lawyers, who want them to throw out all communication between Cohen, the company and its employees.

However, on April 9, federal agents executed search warrants against Cohen as part of an ongoing criminal investigation - leading to the request to put the civil case brought by Daniels on hold. Or, they said, the court could appoint a special master for that goal.

In their search Monday, investigators also sought records relating to Cohen's ownership of taxi medallions - high-value assets often used as collateral for loans, according to people familiar with the matter.

Pressed later whether Cohen was still acting as Trump's attorney, Sanders demurred.

Those confidentiality rules can be set aside under certain circumstances if investigators have evidence that a crime has been committed.
