Arrest MLA Sengar immediately, Allahabad High Court directs CBI

The high court has also asked for a progress report of the case by May 2, and said that Sengar should not just be detained, he should be arrested for his crimes.

The minor girl had alleged that she was raped by Kuldeep Singh Sengar, the BJP legislator from Unnao, and his brother past year, but the police refused to take any action against them.

A bench of Chief Justice D B Bhosale and Justice Suneet Kumar, taking cognisance of the gangrape case on a letter to the court by senior lawyer Gopal Swaroop Chaturvedi, heard the matter in detail and will pronounce its order on Friday. The high court asked the state government counsel, "Why has the MLA not been arrested yet?" and sought a reply post lunch. "The whole family is going through a mental trauma", claimed Sengar's wife and added: "Till now not even a single evidence of my husband's involvement in the rape has been produced and ironically he has already been declared a rapist", she asserted.

'As the case has been recommended to the CBI, hence there was no reason seen to initiate any action against the MLA.

A Special Investigation Team, investigating the case, had submitted its report to the government Wednesday evening.

The court directed the central agency to carry out the investigation strictly in accordance with the law and consider filing an application for the cancellation of the bail granted to other accused in the Unnao rape case. The CBI registered three separate cases in connection with the alleged rape and detained Sengar for questioning in the early hours today.

The High Court also rapped the chief minister Yogi Adityanath government saying that it was "directly in league and under influence of the MLA" which delayed the arrest of Sengar. "If this is the conduct of the police in the state, who will a victim approach to register a complaint", the court said.

Meanwhile, the advocate general informed the HC that action is being taken against errant officers who didn't lodge FIR.

An FIR was registered against Sengar in Makhi police station on Thursday.

That is the current situation in the governance of Uttar Pradesh, where a rabid lawmaker is allowed to roam free, with the rape victim trying to commit suicide at the door of Chief Minister Yogi Adityanath and her father being beaten to death in police custody.

An FIR was lodged against Sengar on Thursday under sections 363, 366, 376, 506 of the Indian Penal Code (IPC) and Protection of Children from Sexual Offences (POCSO) Act, and the case was handed over to the CBI.

The victim has alleged that BJP MLA Kuldeep Singh Sengar and his aides raped her in June 2017.
