Chief Secy assault case: AAP MLA Prakash Jarwal gets bail

Says move to send notice seemed as attempt to circumvent process of law.

Prakash has challenged the notice issued by the Committee which had asked him to appear before it on Thursday.

"What was the urgency of issuing a notice now? Wait for the outcome of the main petition pending in the high court", Justice Shakdher told the assembly counsel.

On March 6, he was served with a notice by the Assembly's Question and Reference Committee with a direction that he should present himself before it on March 8.

Jarwal's counsel Rebecca John told the court that her client is ready to give an undertaking, including that he will maintain distance from the Chief Secretary, and requested court to grant him bail. Senior advocate Sanjay Jain, appearing for Prakash, argued it was a clear case of attempt to browbeat and intimidate his client, adding that the notice amounts to overreaching the process of law and was actually an act of contempt of court. However, when he was asked to appear at 5 PM the same day, Prakash once again said that he could not appear because of health reasons.

The Privileges Committee had earlier assured the court that it will not proceed in the matter concerning the chief secretary till further orders.

On Feb 20, Chief Secretary Anshu Prakash alleged that he was manhandled and abused at Chief Minister Arvind Kejriwal's home by two lawmakers of the ruling Aam Aadmi Party (AAP) the previous evening, media reports said. They both are in jail.

The Delhi High Court had on Thursday reserved its order Jarwal's bail plea while expressing her concern over what she termed was a very unfortunate situation where the state and the officers felt unsafe and were being threatened by each other.

Jain said the chief secretary is the executive head of the state and he can not be treated in this manner.

Vashisht claimed that no malafide or malice can be attributed in the issuance of the notice.
